1. Acceptance of Terms
Welcome to Medicare Tips. These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "your") and Medicare Tips LLC ("Medicare Tips," "we," "us," or "our"), governing your access to and use of the website located at medicaretips.org (the "Site") and all related content, tools, features, and services (collectively, the "Services").
By accessing or using our Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Site.
2. About Medicare Tips
Medicare Tips publishes educational materials to help seniors and their adult children fully understand Medicare coverage options and how to maximize Medicare benefits. We can connect you with licensed brokers and insurance companies that service your area (collectively, "Partners").
Medicare Tips is not an insurance company, insurance carrier, or insurance broker. We do not sell, underwrite, or administer insurance policies. We do not provide insurance quotes. When you submit your information through our Site, we may share it with one or more Partners who may contact you to discuss Medicare plans and related insurance products. Any insurance product you ultimately purchase is between you and the applicable insurance carrier or agent; Medicare Tips is not a party to any such transaction.
Partners are independent insurance professionals and companies. They are not employees or agents of Medicare Tips. We receive compensation when we connect you with Partners, but we do not control their conduct, advice, or the insurance products they may offer you.
3. Eligibility
You must be at least 18 years of age to use the Site. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Site on behalf of another person (for example, a parent or family member), you represent that you have the legal authority to act on that person's behalf and to bind them to these Terms.
4. Description of Services
Through the Site, we provide:
- Educational content: Articles, guides, tools, and other informational resources about Medicare, Medicare Advantage, Medicare Supplement (Medigap), Prescription Drug Plans, and related topics.
- Connection services: The ability to submit your information so that we may connect you with licensed insurance agents, agencies, and carriers in your area who can assist you with Medicare-related products.
- Communications: Optional email updates and SMS/text message updates, subject to your opt-in consent and the terms described in our Privacy Policy.
5. Consent to Be Contacted
When you submit your personal information through our Site (including your name, phone number, email address, zip code, and date of birth), you understand and agree that:
- Your information may be shared with one or more Partners, as described in our Privacy Policy.
- Partners may contact you by telephone, email, or text message regarding Medicare plans and related insurance products.
- If you separately opt in to receive SMS/text message updates and/or email updates by checking the applicable boxes on our Site, you provide your prior express written consent to receive such communications from us and our Partners, as described in the opt-in disclosure presented to you at the time of consent.
The opt-in disclosure states:
"By checking the relevant box above, you agree to receive text messages and/or email updates from us and our partners. Message and data rates may apply. Messaging frequency varies. To opt out, reply STOP to any text message or click the unsubscribe link in email updates."
Consent to receive communications is not required to use our educational resources or to be connected with a licensed insurance agent. You may revoke consent at any time as described in our Privacy Policy.
6. Telephone Consumer Protection Act (TCPA) Consent
By providing your telephone number and checking the SMS opt-in box on our Site, you provide your prior express written consent, as defined under the Telephone Consumer Protection Act (47 U.S.C. § 227) and applicable FCC regulations, to receive autodialed and/or prerecorded telemarketing calls and text messages from Medicare Tips and its Partners at the telephone number you provided. You understand that:
- Consent is not required to use our educational resources or to be connected with a licensed insurance agent.
- Message frequency may vary. Message and data rates may apply.
- You may revoke consent at any time by replying STOP to any text message, or by contacting us using the form on the Contact Page.
- We will process revocation requests within 10 business days in accordance with FCC requirements.
- After your information has been shared with a Partner, you must contact that Partner separately to revoke consent to their communications.
You represent and warrant that the telephone number you provide is your own number or that you are authorized to provide consent for that number. You understand that consent may be revoked at any time and that revocation applies only to future communications.
7. No Professional Advice
The educational content provided on our Site is for general informational purposes only. It is not intended as, and does not constitute, professional medical advice, legal advice, financial advice, tax advice, or insurance advice. The information on our Site should not be relied upon as a substitute for consultation with qualified professionals.
Medicare Tips makes no representations or warranties regarding the accuracy, completeness, or timeliness of any information on the Site as it relates to your individual circumstances. Medicare plans, benefits, costs, eligibility, and enrollment periods are subject to change. You should always verify information directly with the Centers for Medicare & Medicaid Services (CMS) at medicare.gov or with a licensed insurance professional before making any decisions about your Medicare coverage.
Medicare plans, benefits, premiums, and rules change frequently, particularly during the Annual Enrollment Period. While we strive to keep our content current, you should always verify current Medicare information directly with medicare.gov or a licensed insurance professional before making enrollment decisions.
8. Your Obligations
When using the Site, you agree that you will:
- Provide accurate, current, and complete information when submitting any form on the Site.
- Not use the Site for any unlawful purpose or in violation of any applicable law or regulation.
- Not impersonate any person or entity, or falsely represent your affiliation with any person or entity.
- Not attempt to gain unauthorized access to any portion of the Site, its servers, or any systems or networks connected to the Site.
- Not use any automated means (including bots, scrapers, crawlers, or spiders) to access, monitor, or copy any content or data from the Site without our prior written consent.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any Content on the Site, except as follows:
- You may temporarily store copies in your web browser cache for the purpose of viewing the Site.

12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MEDICARE TIPS LLC, OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY (INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), ARISING OUT OF OR IN CONNECTION WITH:

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Medicare Tips LLC, and their respective officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of the Site or Services.
- Your violation of these Terms.
- Your violation of any applicable law or the rights of any third party.
- Any information you submit through the Site, including any inaccurate or misleading information.
14. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
A. Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first contact us using the form on the Contact Page and attempt to resolve the dispute informally for at least thirty (30) days. Most concerns can be resolved this way.
B. Binding Arbitration
If we are unable to resolve a dispute informally, you and Medicare Tips agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services (collectively, "Disputes") shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual action in small claims court if the claim qualifies.
Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall take place in Palm Beach County, Florida, unless you and we agree otherwise, or the AAA rules permit the arbitration to be conducted remotely. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
C. Class Action Waiver
YOU AND MEDICARE TIPS AGREE THAT EACH PARTY MAY BRING DISPUTES ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one party's claims and may not preside over any form of representative or class proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and the dispute shall proceed in court.
D. Exceptions
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in court to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
15. Governing Law
These Terms and any Disputes shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. To the extent that litigation is permitted under these Terms, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Palm Beach County, Florida.
16. Termination
We reserve the right to suspend or terminate your access to the Site at any time, with or without cause and with or without notice, at our sole discretion. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.
17. Modifications to These Terms
We reserve the right to modify these Terms at any time. When we do, we will revise the "Last Updated" date at the top of this page. If we make material changes, we will provide notice as required by applicable law (such as a prominent notice on the Site). Your continued use of the Site after the effective date of any revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Site.
18. Electronic Communications
By using the Site and providing your contact information, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This consent applies to communications related to your use of the Site and does not override the separate opt-in requirements for marketing emails and SMS/text messages described in Section 5 of these Terms and in our Privacy Policy.
19. Accessibility

20. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
21. Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Medicare Tips.
22. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, constitute the entire agreement between you and Medicare Tips regarding your use of the Site and supersede all prior and contemporaneous agreements, proposals, and communications, whether written or oral, relating to the subject matter hereof.
23. Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms, in whole or in part, at any time without notice to you, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.
